Terms of Service

ThinkSuccess.net provides a Predictive Churn Audit ("The Pilot") and Fractional Account Management Advisory ("The Engagement"). These services are provided on a "research-first" basis, utilizing PhD models to identify retention risks.

• The "Blind" Standard: For the Pilot phase, the Client is responsible for providing anonymized data. ThinkSuccess.net is not liable for any data breaches resulting from the Client’s failure to scrub PII (Personally Identifiable Information) before upload.
• Accuracy: The results of the Success Engine are dependent on the quality of the data provided. ThinkSuccess.net does not guarantee specific NRR (Net Retention Rate) outcomes but provides the diagnostic tools to achieve them.

• Pricing: Standard Fractional Executive services are billed at $7,500/mo (unless otherwise agreed in a specific Statement of Work).
• Payment Terms: Invoices are issued monthly in advance and are payable within 7 days.
• The Audit Fee: For qualified Research Pilot partners, the $5,000 Audit fee is waived in exchange for the use of anonymized data for doctoral research purposes.

• The Success Engine: All methodologies, algorithms, the "Silence Tax" framework, and PhD models are the exclusive property of Niki Clarke and ThinkSuccess.net.
• License: Clients are granted a limited, non-transferable license to use the Success Engine Dashboard and generated reports for internal business purposes only.

• Limitations: To the maximum extent permitted by the laws of England and Wales, ThinkSuccess.net’s total liability shall not exceed the total fees paid by the Client in the 3 months preceding the claim.
• No Professional Advice: While the advisory is based on academic research and 15+ years of experience, it does not constitute legal or financial advice.

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from these terms or the use of ThinkSuccess.net services shall be subject to the exclusive jurisdiction of the courts of London, UK.
